Conditions of Sale

The Following Conditions of Sale and any glossary contained herein are the complete terms and conditions on which all auction lots are offered for sale, sold or purchased. The lots will be offered and sold by Gilroy Foundation.

1. Gilroy Foundation makes no warranties, assumptions of liability, or representation of any kind with respect to said items or services.
2. Gilroy Foundation reserves the right to withdraw any items at any time before actual sale.
3. If the minimum bid is not made, the item will be withdrawn from sale.
4. The highest bidder at the close of Gilroy Foundation’s online auction will be the successful winning bidder.  Winning bidders will be notified via email.
5. At the time of closing, the highest bidder shall be deemed to have purchased the offered lot in accordance with all the conditions set forth herein, and thereupon, assumes the full risk and responsibility for paying the full purchase price. Gilroy Foundation has the right to hold the purchaser liable for the bid price. All sales are final and there will be no exchange, refund, or substitution either by the donor or Gilroy Foundation.
6. All lots will be available for pickup at Gilroy Foundation’s office on Monday, October 5, 2020 by appointment. Certificates will be mailed to winning bidders on Monday, October 5, 2020.
7. The “monetary value” listed for each auction item is a good faith estimate of each item.
8. According to IRS regulations, only the portion of the purchase price which exceeds the fair market value may qualify as a deductible gift. Please consult your tax advisor.
9. All certificates for service must be redeemed by October 2, 2021, unless otherwise noted.
